Legal
Terms of Use
The agreement for using MakeGig as a creator, brand, agency, or campaign manager.
Effective October 29, 20261. Agreement to these terms
These Terms of Use (the "Terms") are a binding agreement between you and MakeGig ("MakeGig," "we," "us," or "our") governing your access to makegig.com and the related services that link to these Terms (the "Service"). By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 18 years old and legally able to enter a binding agreement. If you use the Service for an agency, brand, or other organization, you represent that you have authority to bind it to these Terms, and “you” includes that organization.
2. What MakeGig provides
MakeGig provides tools for creators to discover UGC gigs, research companies, publish portfolios, submit applications, track work, and review brand experiences. It also provides brands, agencies, and campaign managers with tools to publish gigs, manage brands and campaigns, discover creators, review applicants, and communicate with creators.
MakeGig provides software and information. Unless we expressly say otherwise for a particular feature, MakeGig is not an employer, staffing agency, talent agent, payment processor, escrow provider, or party to any agreement between a creator and a brand, agency, or campaign manager. We do not guarantee that any user will receive an application, response, offer, engagement, deliverable, payment, or particular result.
3. Accounts and security
You must provide accurate, current information; keep your credentials and account secure; and promptly notify us of suspected unauthorized use. You are responsible for activity under your account. One person may not impersonate another person, brand, agency, or organization. We may require additional verification when necessary to protect users or the Service.
Creator accounts must include a genuine profile photo. Public profile and portfolio information must accurately represent the creator whose work is displayed. Campaign managers must accurately identify themselves and the brand or agency on whose behalf they communicate.
4. Gigs, applications, and campaign relationships
A user publishing a gig must have authority to recruit for the named brand and must accurately describe compensation, free-product arrangements, deliverables, eligibility, deadlines, usage rights, posting requirements, and material conditions. Do not post speculative, deceptive, unlawful, discriminatory, or unavailable opportunities.
Creators are responsible for evaluating gigs before applying and for the accuracy of their applications and portfolio claims. Brands, agencies, campaign managers, and creators must separately agree on scope, revisions, approvals, intellectual-property or usage rights, exclusivity, expenses, shipping, taxes, payment method, and payment timing. MakeGig does not collect or distribute compensation for current creator-brand engagements and is not responsible for either party’s performance or payment.
Links in imported or externally sourced gig listings may lead to a third party’s application process. The third party’s terms and privacy policy apply there, and MakeGig does not control that process.
5. Company directory and public information
The company directory may combine information from public business websites, social profiles, company representatives, creators, campaign managers, and other lawful sources. Directory information may be incomplete, outdated, or incorrect. You should independently verify information that matters to a business decision. A company or affected person may request a correction or removal review by contacting us.
When adding a brand, you must provide the brand’s official public website and confirm that it is a real brand you have worked with or legitimately manage. Do not submit personal sites, portfolios, referral pages, unrelated domains, or a business you falsely claim to represent.
6. Reviews, evidence, and responses
A review must describe a genuine first-hand working experience. It must be honest and must not contain knowingly false or misleading claims, threats, harassment, impersonation, unlawful discrimination, personal contact details, trade secrets, or confidential information you do not have the right to disclose. Incentivized, coordinated, retaliatory, or duplicate reviews are prohibited.
Supporting evidence is private and may be used for verification, moderation, dispute handling, and platform safety. Brands may be able to publish a response. We may label, limit, preserve, reject, or remove content when we reasonably believe it violates these Terms, presents legal or safety risk, or undermines review integrity. Moderation does not mean we endorse or independently verify every statement.
7. Messaging and acceptable outreach
Messaging is for relevant creator-campaign communication. Do not send unsolicited bulk messages, repeated unwanted messages, scams, malware, deceptive offers, or content that is harassing, sexual, hateful, threatening, or unlawful. Honor requests to stop contacting someone. MakeGig may apply rate limits, automated abuse controls, message restrictions, and account-level enforcement.
Do not use information obtained through MakeGig to build contact lists, conduct unrelated marketing, or contact someone outside the purpose for which the information was made available.
8. Your content and license to MakeGig
You retain ownership of content you submit. You grant MakeGig a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, format, display, transmit, moderate, and otherwise process that content as reasonably necessary to operate, secure, improve, and promote the Service. For content you make public, this license includes displaying and distributing it through public profile, company, review, and gig pages.
You represent that you own or have permission to use everything you submit, including names, logos, photographs, portfolio work, music, video, testimonials, brand materials, and personal information. You must obtain releases or permissions required for people, music, products, locations, or third-party works appearing in your content.
You may remove content using available controls. The license ends when the content is deleted from active systems, except for copies reasonably retained in backups, security records, legal records, or content other users have lawfully shared or relied upon.
9. Prohibited conduct
- Break the law; infringe intellectual-property, privacy, publicity, or other rights; or encourage others to do so.
- Scrape, crawl, harvest, probe, reverse engineer, overload, disrupt, or bypass technical restrictions, authentication, rate limits, or security controls, except where law expressly permits it.
- Upload malicious code; exploit a vulnerability; access another account; or attempt to obtain non-public data.
- Manipulate reviews, applications, campaign statistics, social metrics, identities, or platform activity.
- Use bots or automation to create accounts, send messages, submit applications, or extract data without our written permission.
- Use the Service to discriminate unlawfully or to make eligibility decisions based on sensitive demographic data where prohibited.
- Publish or solicit adult sexual content, illegal products or services, pyramid schemes, or fraudulent opportunities.
10. Intellectual property and feedback
MakeGig and its licensors own the Service, software, design, compilation, and branding, excluding user content and third-party marks. These Terms do not grant you a right to use MakeGig’s name, logo, or trademarks. If you provide feedback, you grant us a perpetual, worldwide, irrevocable, royalty-free right to use it without restriction or compensation.
11. Third-party services and AI-assisted features
The Service may link to or use third-party services for hosting, authentication, analytics, email, social metrics, and other functions. Third-party services are governed by their own terms and policies, and MakeGig is not responsible for their availability, content, or conduct.
If an AI-assisted drafting feature is available, generated content may be inaccurate, incomplete, or inappropriate. You must review and edit every draft and remain responsible for anything you publish or send. MakeGig does not automatically send an AI-generated message on your behalf.
12. Suspension and termination
You may stop using MakeGig at any time and may request account deletion through account settings. We may investigate, restrict, suspend, or terminate access; remove or preserve content; or limit features when reasonably necessary to enforce these Terms, protect users, comply with law, prevent abuse, or maintain the Service. Where practical, we may provide notice and an opportunity to appeal, but we are not required to do so when immediate action is reasonably necessary.
13. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” MAKEGIG DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT A USER, GIG, APPLICATION, REVIEW, SOCIAL METRIC, COMPANY RECORD, OR OTHER INFORMATION WILL BE ACCURATE, COMPLETE, CURRENT, OR SUITABLE FOR YOUR NEEDS.
You are responsible for evaluating other users, opportunities, agreements, content, and links and for protecting yourself in off-platform transactions.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAKEGIG AND ITS TEAM WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OPPORTUNITIES, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAKEGIG’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID MAKEGIG IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US$100. Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you.
15. Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless MakeGig and its team from claims, losses, liabilities, damages, judgments, costs, and reasonable legal fees arising from your content, your use of the Service, your campaign or creator relationship, your violation of these Terms, or your violation of another person’s rights. We may control the defense of a covered matter, and you agree to cooperate with us.
16. Changes, general terms, and contact
We may modify the Service and these Terms. If a change materially affects your rights, we will provide notice as required by law. Updated Terms are effective on the date shown above, and continued use after that date constitutes acceptance.
If any provision is unenforceable, it will be modified to the minimum extent necessary and the remainder will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, merger, acquisition, or sale of assets. These Terms, together with policies expressly incorporated by reference, are the entire agreement concerning the Service.
Questions or legal notices may be sent to contact@makegig.com. Before filing a claim, please contact us and provide a reasonable opportunity to resolve the issue informally.
